The Ministry of Justice has revealed its urgent action plan to fight the phenomenon of illegal appropriation of other peoples’ properties, its eradication and implementation, in accordance with the royal message addressed to the Minister of Justice and Freedoms dated back to December 30, 2016.
This revelation has come in the written question presented by the PJD team to the Justice Minister Mr. Abdellatif Ouahbi.
The Justice department has confirmed that, in addition to amendments which have concerned a number of regulations to stand up against the illegal appropriation of properties, an inventory process was established to count abandoned properties in coordination with the Interior Ministry and the National Agency for Real Estate Preservation and Mapping, pointing out that local committees at various provinces and Governors’ Offices have limited the number of abandoned properties in 8299 properties and after an audit by the National Agency for Real Estate Preservation, it was disclosed that the number included 4037 registered properties.
The same source said that the National Agency for Real Estate Preservation and Mapping has launched an electronic service called “Muhafadaty”, to allow real estate owners to follow up the status of their own properties without moving to real estate offices, through messages sent via their mobile phones and e-mails at any new restrictions about properties fees. Real estate ads service was included electronically in that package service allowing interested persons to get informed about any ads which are published in the official bulletin.
Another electronic service was launched and it concerns request and delivery of certificates and documents, while taking all necessary measures and arrangements for verification of the authenticity of documents and contracts signed abroad through corresponding with foreign officials and according to approved agreements using all possible channels to speed up implementation of above-mentioned measures, on the basis of cooperation among professional bodies of notaries of interested countries and assisting Moroccan judges in some foreign countries to make sure of the documents authenticity.
The Justice Ministry has recorded that those measures have largely contributed to fight and limit the phenomenon of illegal appropriation of other peoples’ properties; therefore, up till the end of last March of last year, 42 cases of that illegal practice have been recorded 17 among them are still under investigation and 3 others are at the first instance court, 14 at the court of appeal and 8 at the court of cassation.
The Ministry of Justice is preparing to issue a number of decrees to stand up against the illegal appropriation of other peoples’ properties including an organizational bill which concerns real estate companies and the bill for contracts archiving in addition to another bill that concerns national record of agencies involved in rights in rem.
