The House of Representatives adopted unanimously last Monday, May 23, 2022, in the context of a second reading, the bill number 38.15 related to judiciary organization which was presented by Minister of Justice Mr. Abdellatif Ouahbi.
In his intervention during the voting session on the bill, Minister Ouahbi has talked about the bill new provisions and important amendments being adopted by Parliamentary teams, saying “the preparation and adoption of this bill has come in the context of the Justice Ministry implementation of its strategy to reform the justice apparatus and which relies on several national and international backgrounds on their top the supreme royal determination expressed by His Majesty King Mohammed VI in the historical speech of August 20, 2009 on the occasion of the commemoration of the 56th anniversary of the Revolution of the King and the People and in the context of the implementation of the Kingdom’s 2011 constitution provisions which has consolidated the independence of the judiciary power from the legislative and the executive. The bill has also responded to the goals and recommendations set up by the justice reform charter which confirms easy access to law and justice and provides close and efficient justice to litigants and increases judiciary performance”.
The bill has also come, added the Minister “in the context of modernizing national legal arsenal to keep abreast with international legislative progress and with the basics of world agreements, and in response to litigants’ requirements and ambitions”.
The Minister stated “The Justice Ministry has assumed its responsibility by necessarily reviewing judiciary organization according to a broad participative approach to which many active essential players of the judiciary apparatus have contributed for the sake of elaborating this completed bill which contextualizes courts action in our country, including easy access to justice, bringing justice closer to litigants and increasing the efficiency of the judiciary.. The Minister confirmed that the older version of the bill no longer responds to the Kingdom’s constitution provisions which have raised the ceiling high in terms of protecting individuals and communities’ rights and freedoms
Minister of Justice has expressed his gratitude to all MPs teams integration from both houses, majority and opposition alike for the discussions of this project, making clear that the government has responded positively with many amendments presented by MPs teams and adopted by the commission of justice, legislation and human rights at the House of Representatives.. According to the government official, the current version of text project included 111 articles divided into four chapters; the first one included principles and basics of judiciary organization, litigants’ rights; the second one on organization of courts and their specialties; while the third one is about inspection and judiciary supervision of courts and the fourth one is about various and transitional provisions.
