Minister Abdellatif Ouahbi: Ministry of Justice ready to apply bill of alternative penalties for freedom-depriving penalties regarding simple offenses

Minister of Justice Mr. Abdellatif Ouahbi has disclosed that the code bill of alternative sentences for freedom-depriving penalties in simple offenses has been submitted to the government’s secretariat general, and it’s open to discussion regarding its final formulation before issuance to be included as an independent bill or partially in the penal code, while its second part will be included in the civil code.

Minister Ouahbi confirmed in his response to MPs questions during an oral session held at the Parliament last Monday, November 28, 2022, that the Ministry of Justice is ready to apply the bill including the penalty of “e-bracelet” upon its adoption, making clear: “Not any action will be punished and putting in jail, but alternative sentences will be established”, adding “there’s a special independent bill which we have submitted to government’s secretariat general; however there are still some disagreements about its final formulation and that will take more time.. We have chosen to put an independent bill after we have got informed that more than 20 countries have established an independent bill regarding alternative penalties”.

Minister Ouahbi has disclosed that alternative penalties were excluded in crimes such as treachery, embezzlement, bribery, abuse of power, illegal drugs trafficking, illegal trafficking of human organs and illegal trafficking of emigrants and child’s sexual exploitation, because all those crimes come under firm imprisonment penalties, while other remaining crimes are subject to alternative penalties.
