Minister of Justice Mr. Abdellatif Ouahbi has disclosed a number of new measures intended to face problems related to the Implementation of judicial rulings, in the light of legislative texts the Justice Ministry is preparing to speed up the pace of executing those rulings.
Minister of Justice Mr. Ouahb ui has reminded, in his response to a written question submitted by the MP party, that bill number 38.15 and the civil code project bill, have included many new developments bearing answers to several concerns and expectations in this field, including the creation of execution judge institution with defining his/her competencies and the procedures to be followed.
The execution judge institution was created by the bill number 38.15 which appoints new execution judges at different courts of first instance, at commercial courts and at administrative courts, in implementation of the recommendations of the national charter to reform the judiciary apparatus.
The project bill for the civil code procedure, added the government official, has included some provisions stipulating the execution judges’ competencies and direct supervision mandate as related to administrative measures in the process of judicial execution.
Regarding the audits of seizure of movables and real estate, Minister of Justice has pointed out that the Ministry is working on monitoring the procedures in this regard with ensuring the interests of those who have asked for seizure or the side to be subject to seizure; and also the execution procedure to be followed.
Minister Ouahbi has emphasized that those measures have come to embody royal determination expressed by His Majesty King Mohammed VI in his speech of August 9, 2009, made on the occasion of the commemoration of the Revolution of the King and the People, in the context of instructing the government to activate the judiciary apparatus reform to face different shortcomings suffered by a low and complicated judiciary procedures.. Minister Ouahbi has concluded by saying that executing courts’ rulings is very important to guarantee judicial rights and respect of law-enforcement.
