بحضور خبراء وأساتذة متخصصين بالمادة الجنائية..فرق الأغلبية بمجلس النواب تعمق النقاش في مشروع المسطرة الجنائية المُراجع

نظمت فرق الأغلبية بمجلس النواب يومه الخميس 13 مارس 2025، لقاء دراسيا حول موضوع “مشروع القانون رقم 03.23 بتغيير وتتميم القانون رقم 01. 22 المتعلق بالمسطرة الجنائية في ضوء التحولات المجتمعية بالمغرب”، لدراسة مختلف المستجدات الواردة في مشروع القانون من طرف خبراء وأساتذة متخصصين في المادة الجنائية.

وقارب اللقاء الدراسي المنعقد بحضور وزير العدل السيد عبد اللطيف وهبي، وترأسه رؤساء فرق الأغلبية بمجلس النواب، مستجدات مشروع قانون المسطرة الجنائية من خلال ستة محاور متكاملة تعكس تنوع المقاربات والتصورات بما يغني النقاش العمومي بخصوص مشروع هذا القانون ويجعل مجلس النواب فضاء للنقاش المتعدد.

وأفادت فرق الأغلبية في أرضية اللقاء الدراسي أن مشروع قانون المسطرة الجنائية المُراجع حمل العديد من المستجدات بالغة الأهمية سواء على مستوى تعريفه للسياسة الجنائية أو تفصيل طرق الطعن غير العادية والمساطر الخاصة أو تعزيز حقوق الدفاع خصوصا على مستوى مراجعة الضوابط القانونية المتعلقة بالوضع تحت الحراسة النظرية خصوصا ما يتعلق بالتنصيص على اَلية التسجيل السمعي البصري.

كما جاء في مشروع القانون تضمن تعزيز حق الأشخاص الموضوعين تحت رهن التدابير الحراسة النظرية في الاتصال بمحاميهم بضمانات إضافية، وعدم جواز تمديد مدة الحراسة النظرية إلا بمقتضى أمر كتابي معلل صادر عن النيابة العامة بالنسبة لكافة الجرائم وتعزيز ضمانات الوقاية من التعذيب، واعتبار الاعتقال الاحتياطي تدبيرا استثنائيا لا يتم اللجوء إليه إلا إذا تعذر تطبيق تدابير بديلة عنه وإضافة الوضع تحت المراقبة الإلكترونية إلى تدابير المراقبة القضائية، وتعزيزا لإجراءات ترشيد الاعتقال الاحتياطي وتنزيلا لقانون العقوبات البديلة والعناية بالمركز القانوني للإحداث وتعزيز التعاون الدولي في تنفيذ المقررات.
