مجلس المستشارين يصادق على تغيير وتتميم أحكام مشروع القانون المتعلق بالتنظيم القضائي

صادق مجلس المستشارين، اليوم الثلاثاء 11 فبراير 2025 خلال جلسة تشريعية خصصت لمناقشة والتصويت على النصوص الجاهزة، على مشروع قانون يتعلق بتغيير وتتميم أحكام 74 و 75 من القانون رقم 38.15 المتعلق بالتنظيم القضائي.

ويهدف هذا المشروع قانون إلى فتح إمكانية استئناف المقررات الصادرة عن المحاكم الابتدائية التجارية والمحاكم الابتدائية الإدارية أمام القسم المتخصص في القضاء التجاري والقسم المتخصص في القضاء الإداري التابعين لمحكمة الاستئناف العادية.

كما يروم هذا النص التشريعي الجديد إلى تقريب القضاء المتخصص من المواطنات والمواطنين، بفتح إمكانية استئناف أحكام المحاكم الابتدائية التجارية وأحكام المحاكم الابتدائية الإدارية أمام القسم المتخصص في القضاء التجاري والقسم المتخصص في القضاء الإداري التابعين لمحكمة الاستئناف العادية.

وسيخول تعديل مقتضيات المادتين 74 و75 من قانون التنظيم القضائي لمجموع المرتفقين إمكانية اللجوء إلى القضاء المتخصص في الدوائر القضائية بمحاكم الاستئناف، التي لا تتوفر على محاكم متخصصة بفتح الاختصاص الترابي للأقسام المتخصصة في دوائر هذه المحاكم الاستئنافية، ما سيساعد على تخفيف العبء على المرتفق بتجنيبه مصاريف التنقل إلى محاكم قد تكون بعيدة عن مقر إقامته في انتظار تعميم المحاكم المتخصصة بمختلف ربوع المملكة
وسيمكن هذا التعديل من تحقيق نوع من المرونة على الخريطة القضائية للمملكة، عبر استغلال أفضل للبنيات التحتية للمحاكم وتعبئة ذكية للموارد البشرية واللوجستيكية.
