The House of Representatives.. Minister Abdellatif Ouahbi presents three bills at the Justice and Legislation Commission

The Justice, Legislation and Human Rights Commission at the House of Representative held last Monday, March 14, 2022, a meeting in the presence of Minister of Justice Mr. Abdellatif Ouahbi about presenting three bills.

The first bill concerns regulatory act number 86.15 about setting conditions and measures to push for unconstitutional acts.

This regulatory act has come in implementation of chapter 133 of the constitution which stipulates on the competency of the constitutional court of justice to reexamine any push related to an unconstitutional act, being raised during a specific issue, in case one of the parties acclaims that the law which will be implemented for specific conflicts violates rights and freedoms that are guaranteed by the constitution.

The second bill number 38.15 concerns judiciary regulation which was presented to the House of Councilors. This law enters in the context of accomplishing the arsenal regulations about implementing the judiciary apparatus reform, especially in the aftermath of the appointment of the Higher Council of the Judicial authority and the transition of the General Prosecutor Presidency to the King’s Attorney at the cassation court; since it aims at governing the relationship between the judicial power, the General Prosecutor Presidency and the Ministry in charge of justice inside the courts and this helps define the Ministry’s competencies in the field of managing judicial administration.

Regarding the third bill number 95.17, it concerns arbitration and mediation agreement which was also presented to the House of Councilors. This bill has come within the framework of completing the implementation of the judicial apparatus reform planning, the modernization and improvement of the national legal system which regulate funds and businesses. This bill aims also at separating the provisions of arbitration and mediation agreement from the civil law code, with introducing some necessary amendments.
