The House of Councilors adopted the unconstitutionality bill

​The House of Councilors adopted on Tuesday, July 26, 2022, the unconstitutionality organizational bill number 86.15. The bill aims at defining conditions and measures to resort to constitutional judiciary by using constitutional mechanism endorsed by chapter 133 of the 2011 Moroccan constitution, and which has come in application to chapter 23 of the organizational bill number 066.13 related to the constitutional court.

​PAM team at the House of Councilors has considered this legal text as among the most important laws that reinforce the construction of the rule of law state, constitutional institutions, and broad and deep reform of the justice apparatus.

​PAM team has clarified, in this regard, that Moroccan citizens, women and men could defend their right and freedoms by requesting the unconstitutionality clause and this is through a number of procedures that would allow them to activate their contacts with constitutional institutions and in full respect of the supremacy of the constitution; the fact which will contribute to revise legal system and implement both individual and collective awareness for rights, freedoms and commitments and therefore reinforce genuine civic democracy.

​PAM team has expressed its appreciation towards the participation of the General Attorney’s Office in this procedure, which has come in full accordance with the constitution’s provisions, since the constitutional court will be in charge of handling the unconstitutionality bill, while the courts role will be to make clear and double check unconstitutionality requests as endorsed by the law.
