الحكومة تصادق على مشروع مرسوم حول نفقات المجلس الاقتصادي والاجتماعي

صادق مجلس الحكومة، أمس الخميس 25 أبريل الجاري، على مشروع المرسوم رقم 2.23.1144 بتغيير وتتميم المرسوم رقم 2.11.344، الصادر في 9 ذي القعدة 1432 (7 أكتوبر 2011)، المتعلق بمساطر تنفيذ نفقات المجلس الاقتصادي والاجتماعي (صيغة جديدة).

وقالت الحكومة، إن هذا المشروع يأتي بعدما تم نسخ المرسوم رقم 2.12.349 بموجب المرسوم رقم 2.22.431، الصادر في 15 من شعبان 1444 (8 مارس 2023) المتعلق بالصفقات العمومية، حيث أصبح من الضروري ملاءمة الإطار التنظيمي المتعلق بمساطر تنفيذ نفقات المجلس الاقتصادي والاجتماعي.

وأوضحت الحكومة أن المشروع يهدف إلى تغيير وتتميم بعض أحكام المرسوم السالف الذكر رقم 2.23.344، وتمكين المجلس المذكور من إبرام عقود أو اتفاقيات خاضعة للقانون العادي، إذا كان موضوعها يروم إنجاز بعض الأعمال غير الواردة في الملحق رقم 1 المرفق بالمرسوم المتعلق بالصفقات العمومية الجاري بها العمل.

وأضافت الحكومة أنه انسجاما مع أحكام الدستور والقانون التنظيمي رقم 128.12 المتعلق بالمجلس الاقتصادي والاجتماعي والبيئي، تم أيضا تعويض عبارة المجلس الاقتصادي والاجتماعي الواردة في عنوان المرسوم السالف الذكر رقم 2.11.344 وبعض أحكامه بعبارة “المجلس الاقتصادي والاجتماعي والبيئي”.
