النيابة العامة.. تصدر دورية لتعديل شروط إخضاع المبحوث عنهم للحراسة النظرية

أصدر الوكيل العام للملك لدى محكمة النقض رئيس النيابة العامة، بتاريخ الاثنين 12 أبريل الجاري، (دورية) تضمنت تعليمات موجهة إلى الوكلاء العامين للملك لدى محاكم الاستئناف، ووكلاء الملك لدى المحاكم الابتدائية، وذلك على خلفية العمل على تدبير برقيات البحث، وسعيا “إلى تحقيق الأمن القضائي للأفراد وحماية حرية الأفراد والحد من تقييدها بما يتطابق مع أحكام الفصل 23 من الدستور”.

وأكدت الدورية على “الحرص على ترشيد اللجوء إلى إصدار برقيات البحث، وعدم توجيه تعليمات بتحريرها إلا في الحالات الضرورية التي تستدعي مثول الشخص المبحوث عنه أمام العدالة، كما لو تعلق الأمر بالاشتباه في ارتكاب جنايات أو جنح تنطوي على خطورة، مع توفر قرائن أو أدلة كافية على ارتكابها” و”التريث في معالجة قضايا الأشخاص المبحوث عنهم الذين يتم ضبطهم، وعدم اللجوء آليا إلى إخضاعهم للحراسة النظرية، ما لم تقتض ظروف البحث وضروراته ذلك”.

وشددت الدورية ذاتها على ضرورة “القيام بمراجعة دورية للمحاضر المحفوظة عقب إنجاز برقيات البحث، وذلك بهدف التحقق من استمرار توفر المبررات القانونية التي أدت إلى إصدار التعليمات بتحرير تلك البرقيات”، و”المبادرة إلى إصدار تعليمات ترمي إلى إلغاء جميع برقيات البحث المتعلقة بأفعال جرمية طالها التقادم القانوني. مع مراعاة اختلاف هذه المدة بحسب الطبيعة القانونية للجريمة (جناية أم جنحة)، وبطبيعة الحال مراعاة الأسباب القانونية لقطع التقادم”.

وأكدت الدورية في السياق ذاته، على “الحرص على إلغاء برقيات البحث المحررة في حق المشتبه فيهم المقدمين أمام النيابات العامة، أو عند إحالة قضايا الأشخاص المبحوث عنهم على جهات التحقيق أو الحكم”، و”التفاعل الإيجابي مع الطلبات والملتمسات التي تقدم من أجل إلغاء برقيات البحث، والعمل على إصدار تعليمات بإلغائها متى ثبت وجود مبررات قانونية توجب ذلك”.
