مجلس الحكومة يصادق على مشروع قانون إحداث وتنظيم المؤسسة المحمدية للأعمال الاجتماعية لقضاة وموظفي العدل

صادق مجلس الحكومة، اليوم الخميس، على مشروع القانون رقم 25.25 بتغيير وتتميم القانون رقم 39.09 الصادر في 16 من رمضان 1432 (17 أغسطس 2011) القاضي بإحداث وتنظيم المؤسسة المحمدية للأعمال الاجتماعية لقضاة وموظفي العدل، قدمه وزير العدل السيد عبد اللطيف وهبي.

ويأتي مشروع هذا القانون لمواكبة التحولات التي عرفها المرفق القضائي بعد مرور أكثر من 20 سنة على إحداث المؤسسة المحمدية للأعمال الاجتماعية لقضاة وموظفي العدل، ولاسيما تخويل المندوبية العامة لإدارة السجون وإعادة الإدماج سنة 2008، وضعية قطاع مستقل بذاته عن وزارة العدل، ووضعها تحت سلطة المندوب العام لإدارة السجون وإعادة الإدماج، وكذا صدور دستور المملكة لسنة 2011، الذي كرس استقلالية السلطة القضائية عن السلطتين التشريعية والتنفيذية، وتخويل المجلس الأعلى للسلطة القضائية تدبير شؤون القضاة والشأن القضائي.

ويهدف مشروع القانون إلى تغيير وتتميم القانون رقم 39.09 المتعلق بإحداث وتنظيم المؤسسة المحمدية للأعمال الاجتماعية للقضاة وموظفي العدل، قصد مواكبة هذه التحولات التي تفرض تغييرا في البنية التنظيمية والبشرية لهذه المؤسسة، وذلك من خلال تغيير اسم المؤسسة ليصبح “المؤسسة المحمدية للأعمال الاجتماعية لموظفي العدل”، وكذا إعادة النظر في مهامها، وتعزيز ميكانيزمات تنمية مواردها المالية وتكريس حكامتها على المستويين الإداري والمالي لضمان استدامة أفضل لخدماتها والارتقاء بأنشطتها الاجتماعية، بما يتلاءم والعناية المولوية السامية التي يوليها صاحب الجلالة الملك محمد السادس نصره الله لموظفي العدل.
