M. Ouahbi expose au Parlement les efforts et les réalisations du ministère de la Justice pour la réforme du système judiciaire
Le ministre de la Justice, M. Abdellatif Ouahbi, a mis en évidence les projets et les réalisations dans lesquelles le Ministère de la Justice s’est engagé en vue de la réforme du système judiciaire.
En réponse aux questions des députés parlementaires, lors de la séance de questions orales tenue le lundi 28 novembre, le ministre a affirmé que le ministère a revu un ensemble de lois qui ont été transmises au secrétariat général du gouvernement, à savoir : un projet de loi relatif à la procédure civile, et le projet de loi n° 37.22 relatif à l’institut supérieur de magistrature, le projet de loi relatif à l’Institut national des professions légales et judiciaires et des greffiers, le projet de loi n° 19.21 relative à l’organisation et à la gestion des établissements pénitentiaires , en plus du projet de loi n° 16.03 relative à la profession des Adouls et du projet de loi n° 21.46 relative à la profession de commissaire en justice.
Selon le ministre, le ministère a également soumis, le projet de loi n° 44.22 modifiant et complétant la loi n° 45.00 relative aux experts judiciaires, et au projet de loi n° 27.21 relatif à la numérisation des procédures judiciaires, ainsi qu’un projet de loi portant sur la création de l’Agence nationale de la gestion et de collecte des fonds et des biens saisis ou confisqués, suivi des amendes et des pénalités, et un projet de loi relatif aux peines de substitution, outre la modification de l’article 10 de la loi relative à la nationalité marocaine, un projet de loi de procédure pénale , et un projet de loi révisant l’article 14 du Code des frais de justice dans le domaine pénale.
Le ministre a évoqué les lois étant toujours en cours d’étudeau sein du ministère de la justice, qui veillera sur l’achèvement de révision d’un ensemble de lois incluses dans le régime législatif précité, notamment ceux concernant la matière pénale tels que : le projet de loi n° 10.16 modifiant et complétant l’ensemble de la loi pénale, un projet de loi relatif à l’ordre public applicable aux centres de protection et de réinsertion de l’enfance, et celui portant sur la création d’une Banque Nationale d’empreintes génétiques, et le projet de code des droits de l’enfant.
M. Ouahbi a mentionné les lois en matière civile, tel que leprojet de loi n° 67.19, étant le Code des frais et dépenses judiciaires, un projet de loi réglementant la profession d’avocat, un projet de loi réglementant la profession de notariat, ainsi que celui réglementant la profession de traducteurs admis aux tribunaux, et un projet de loi modifiant et complétant la loi n° 15.01 relative à la prise en charge des enfants délaissés.
À propos de la transformation numérique, le ministre a indiqué que dans le cadre des efforts du ministère pour rapprocher l’administration judiciaire au citoyen, le service de télépaiement des amendes pour infractions et délits suivi par radar fixe a été lancé, et une plateforme de consultationnationale autour de la situation et des perspectives de l’accès de la femme à la justice a été créée, en plus du lancement du casier judiciaire électronique dans sa nouvelle version, le référentiel électronique national des professions légales et judiciaires, ainsi que l’optimisation des sites Internet du Ministère de la Justice, et la mise en place du Call Center, visant à établir des bases de communication efficaces avec tous les intervenants du système judiciaire.
Il a souligné notamment que le ministère de la Justice a déployé des efforts énormes au cours des trois dernières années pour renforcer l’effectif des tribunaux, en organisant des concours de recrutement pour des postes salariales importants, allouant ainsi 500 postes salariales en 2022.
Au niveau de la modernisation et du renforcement des infrastructures des tribunaux, le ministre a confirmé que les efforts se poursuivent dans la construction, l’aménagement, l’entretien et l’équipement, aussi s’active à l’achèvement de construction, d’aménagement et d’agrandissement de 29 tribunaux et centres judiciaires dans différentes villes du Royaume, et 15 tribunaux et centres judiciaires ont été inaugurés en attendant l’inauguration de 17 autres.
Dans la même intervention, le ministre a expliqué que la réforme de la justice est liée à trois piliers : les moyens financiers, les moyens humains et les professions auxiliaires de la justice, soulignant que chacun de ces domaines doit être bien remis en question.
D’un point de vue légal, le ministre estime qu’il y a plusieurs lois qui doivent être revues puisqu’elles sont liées auxtransformations que le ministère de la Justice a subies, telle que la séparation du parquet général et de l’autorité judiciaire, et l’évolution de la société, ce qui nécessite la révision d’un ensemble de lois et le recours à la numérisation.
