Les mémorandums présentés par les centrales syndicales « sont au cœur du processus de négociation » autour du projet de loi organique N° 97.15 définissant les conditions et les modalités d’exercice du droit de grève, a affirmé, jeudi à la Chambre des conseillers, le ministre de l’Inclusion économique, des Petites entreprises, de l’Emploi et des Compétences, Younes Sekkouri.
Lors de sa présentation devant la Commission de l’éducation, de la culture et des affaires sociales du projet de loi organique, selon la formule adoptée par la Chambre des représentants, le ministre a exprimé la disposition du gouvernement à « interagir positivement avec la majorité des propositions des syndicats », indiquant que les centrales syndicales ont présenté des propositions pratiques, qui seront étudiées en vue de leur inclusion dans le projet de loi.
M. Sekkouri a tenu à souligner que la version du texte législatif transmise à la Chambre des conseillers est « temporaire et ouverte aux amendements des conseillers parlementaires ».
Au cours de cette réunion, le ministre a passé en revue les amendements essentiels du projet de loi, qui prévoient notamment de stipuler dans un article, similaire au préambule, que le droit de grève est un droit constitutionnel exercé conformément aux dispositions de cette loi organique, et que toute renonciation à ce droit est considérée comme nulle. Cet article stipule également que ce droit est l’un des droits de l’Homme qui contribuent à la réalisation de la justice et de la paix sociale ainsi qu’à la garantie du contrat social.
Selon M. Sekkouri, cet article garantit l’élargissement du champ des libertés conformément aux conventions internationales pertinentes et valorise les acquis historiques liés à la pratique nationale de ce droit constitutionnel, en plus d’asseoir un équilibre dans la préservation des droits des grévistes, de consacrer la liberté du travail et de préserver les droits des citoyens dans le cadre de l’exercice du droit de grève.
Les amendements concernent également la définition de la grève et l’élargissement des catégories couvertes par l’exercice de ce droit, ainsi que l’élargissement des parties qui appellent à l’exercice de ce droit, en plus de stipuler les motifs de la grève, qui comprennent le dossier des revendications, les points controversés et la dangerosité de la situation, a-t-il expliqué.
D’autre part, M. Sekkouri a fait savoir que les amendements prévoient la protection des droits des grévistes contre toute mesure discriminatoire et contre les sanctions disciplinaires ou le licenciement, en échange de la suppression d’un certain nombre de dispositions relatives à la prévention des grèves à des fins politiques, la suppression de l’interdiction des grèves par rotation, le recours à des sanctions pénales plus sévères et la suppression des peines de prison.
Au niveau de la forme, le responsable précisé que le nombre de chapitres de ce texte législatif a été réduit de 6 chapitres à 4, alors que le nombre de ses articles a été réduit de 49 à 35, en plus de la suppression du chapitre sur les conditions d’exercice le droit de grève dans le secteur privé et le chapitre sur les conditions d’exercice du droit de grève dans le secteur public pour les fusionner en un seul chapitre.
